Haenel pushed aside: HK wins German Armed Forces

The new assault rifle of the Bundeswehr will be the HK416 A8. Winner Haenel has officially been excluded from the tender process, Heckler & Koch gets the contract: The German Ministry of Defense has issued the following statement:

After evaluating all submitted documents, the offer from the company C.G. Haenel has been excluded from further tendering process. The company has already been informed about this. It is now intended to award the contract to the company Heckler & Koch.

Justification:

After finding that one of the bidders may have infringed patents, the process was reset to the stage of offer evaluation.

This was followed by a patent assessment by an external patent law firm. As a result, the experts determined that a patent infringement exists.

The company C.G. Haenel was given the opportunity to submit a statement after presenting the assessments. This statement was submitted in a timely manner, thoroughly reviewed, and taken into account in the overall assessment.

Considering all procurement law aspects, it was ultimately concluded that the offer from the company C.G. Haenel should be excluded due to patent infringements.

The repetition of the offer evaluation is now completed.
