The rabbit is out of the hat: The Federal Procurement Chamber rejected the appeal of the company C. G. Haenel GmbH against the Federal Government in the award procedure for the "manufacture and delivery of assault rifles with accessories for the Bundeswehr" (Sturmgewehr System Project) on June 10, 2021.
In doing so, the Procurement Chamber expressly stated that the Ministry of Defense was right to intend to award the contract in this procurement procedure to Heckler & Koch. Surprisingly, the Procurement Chamber argued: "Ultimately, the procurement chamber did not have to decide on this exclusion due to the cited patent infringement, as Haenel was no longer considered for a contract for other reasons: a necessary recalculation of Haenel's offer price had shown that the company's offer was economically inferior to Heckler & Koch's." The public had previously been informed that Haenel was the significantly more economical bidder - according to Business Insider, 27 million euros cheaper with comparable weapon performance. This was also the argument when the MKB556 was announced as the next Bundeswehr assault rifle (without the public disclosure of the two bidders' prices). But lo and behold: apparently, nobody knows how to do math in Germany anymore, so a recalculation changed everything. HERE is the full explanation from the 1st Federal Procurement Chamber.
The decision is not final. C. G. Haenel is entitled to lodge an immediate appeal with the Higher Regional Court of Düsseldorf within two weeks.
